Terms of Service

The rules for using QuoteKita as a business owner or as a customer getting an estimate from a shop on our platform.

1. Who can use QuoteKita

QuoteKita is a software platform built for Philippine service businesses. Owners use it to publish a public estimator, capture leads, and manage bookings. Customers use it to request an estimate from a participating business.

You must be at least 18 years old to create a business account. By using QuoteKita you agree to these Terms and to our Privacy Policy.

2. Your account

You agree to provide true and complete information at sign-up, keep your password and 2FA factors secure, and take responsibility for everything that happens under your account. Notify us right away if you suspect unauthorised access.

3. Plans, fees, and setup

QuoteKita is sold as a recurring monthly subscription. Some plans include a one-time setup fee that is shown clearly at sign-up. Subscription and setup fees are non-refundable except where Philippine law requires otherwise.

We may change pricing for future billing periods on at least [30 days] notice. A free trial of [14 days] may be offered to new accounts; if a trial is active, your paid plan starts automatically only if you choose to activate it (we do not auto-charge a card at sign-up).

4. What you can and cannot do

You agree to follow Philippine law, including the Data Privacy Act of 2012 (RA 10173), and you will not:

  • publish false, misleading, or bait-and-switch pricing;
  • upload unlawful, infringing, defamatory, or harmful content;
  • attempt to hack, probe, overload, or reverse-engineer the service;
  • use QuoteKita to send spam or unsolicited marketing;
  • collect or contact other shops' customers without consent.

5. Your content and data

You keep ownership of the business content you upload (services, prices, photos, notes, leads). You grant QuoteKita a limited, worldwide licence to host, process, and display that content as needed to run the service for you.

You are the controller of your customers' personal data and are responsible for the lawful basis (consent or otherwise) under which you collect it. See the Privacy Policy for how QuoteKita acts as your processor.

6. Service availability

We work hard to keep QuoteKita running and to ship improvements, but we do not guarantee uninterrupted or error-free service. Features may change, be added, or be removed over time. We are not responsible for failures of your internet connection, your device, or third-party services outside our control.

7. Estimates are estimates

QuoteKita helps a business give a customer an estimate, not a binding final price. The actual price, scope of work, and acceptance of the job are agreed directly between the business and the customer. QuoteKita is not a party to that transaction and is not responsible for the quality, safety, or delivery of services booked through the platform.

8. Third-party services

QuoteKita uses third-party providers for hosting, database, authentication, and email delivery (for example [Supabase], [Resend], and any payment provider you connect). Their terms and privacy policies may apply to data handled through them.

9. Suspension and termination

You can cancel anytime from your dashboard. We may suspend or end an account for breach of these Terms, non-payment, or abuse. After termination we may retain records as required by Philippine law and our retention policy.

10. Limitation of liability

To the maximum extent allowed by Philippine law, QuoteKita is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Our total aggregate liability for any claim is capped at the amount you paid us in the [3] months before the event that gave rise to the claim.

11. Changes to these Terms

We may update these Terms. For important changes we will give reasonable notice through the app or by email. Continued use of QuoteKita after the effective date means you accept the updated Terms.

12. Governing law and venue

These Terms are governed by the laws of the Republic of the Philippines. Any dispute will be brought exclusively before the competent courts of [Quezon City], to the exclusion of any other venue.
